These Terms and Conditions apply to Mamalyn Catering, operated under LPT Corp Pty Ltd. They govern the supply of quotes, bookings, catering orders, delivery services, event services and related dealings with our business.

Booking our catering service means you agree to the quote, pricing, timing, event details and booking terms we confirm with you.

These terms are designed to set clear expectations around quotes, deposits, payments, cancellations, event changes, delivery, customer responsibilities and the way any issues are handled. They should be read together with any quote, invoice, proposal, refund policy or written booking confirmation we provide.

Quotes can change

Quotes are based on the information available at the time and may change if numbers, venue access, timings, staffing or service requirements change before confirmation.

Deposits secure dates

A required deposit or booking payment may be needed to secure a date, confirm work and reserve resources for your event.

Law still applies

Nothing in these terms excludes or restricts any rights that cannot lawfully be excluded under Australian Consumer Law.

1. Acceptance of terms

By requesting a quote, making a booking, placing an order, paying a deposit, approving an invoice or otherwise engaging our services, you agree to these Terms and Conditions.

These terms apply together with any accepted quote, invoice, booking confirmation, service proposal, event schedule, refund policy or written communication we issue to you.

2. Quotes and pricing

Quotes are based on the information you provide at the time of enquiry, including guest numbers, menu selection, service style, venue details, access requirements, timings and delivery location.

Unless otherwise stated, quotes may be withdrawn, changed or expire if not accepted within the stated period or within a reasonable time.

Pricing may change if there are changes to guest numbers, menus, staffing requirements, service periods, public holiday loading, venue logistics, parking, access limitations, delivery conditions, setup complexity or other event requirements.

3. Bookings and confirmation

A booking is not guaranteed until we confirm it. We may require a deposit, written approval, signed acceptance, or full or partial payment before a booking is treated as confirmed.

We reserve the right to refuse a booking before confirmation at our discretion, including where dates, staffing or service requirements cannot be met.

4. Deposits and payments

We may require a deposit or booking payment to secure an event date. Final payment terms will be stated on the quote, invoice or booking confirmation.

Unless otherwise agreed in writing, all invoices must be paid by the due date stated. We may suspend work, decline delivery or withhold service where payment has not been made on time.

Deposits and booking payments are generally non-refundable except where we agree otherwise in writing or where a remedy is required by law.

5. Guest numbers and event changes

You are responsible for providing accurate guest numbers and event details by the deadline we specify.

If guest numbers, dietary requirements, venue details, timing or service requirements change after confirmation, we may revise the price, menu, staffing plan, equipment requirements and delivery arrangements.

Guest number reductions may not reduce the final amount payable once ingredients, labour, equipment or other commitments have already been made.

6. Cancellations and postponements

If you cancel or postpone a confirmed booking, the outcome will depend on timing, preparation already undertaken, stock purchases, labour commitments, supplier commitments and whether the date can be rebooked.

Date transfers are not automatic and depend on our availability. Additional charges may apply to postponements or rescheduled events.

Our Refund Policy forms part of these terms where applicable.

7. Delivery and access

You must provide accurate delivery information, venue access instructions, setup details, loading information and a reliable contact person for the event. Additional costs may apply where access is difficult, delayed or materially different from what was originally described.

8. Service scope

Our service is limited to what is stated in the accepted quote, invoice or booking confirmation. If extra items, labour, equipment, wait time, staffing periods or services are requested outside the original scope, additional charges may apply.

9. Menus and substitutions

Menus are subject to ingredient availability, seasonality, supplier availability and operational requirements. We reserve the right to make reasonable substitutions where necessary, particularly where an ingredient becomes unavailable or impractical to source.

10. Dietary requirements and allergies

You must notify us in advance of any dietary requirements, allergy information, religious food restrictions or other important food-related needs.

While we take reasonable care in preparing and identifying dietary options, we do not guarantee an allergen-free environment unless expressly agreed in writing and operationally possible.

It is your responsibility to ensure accurate dietary information is provided to us in time.

11. Customer responsibilities

You are responsible for:

  • providing accurate event and contact details,
  • ensuring venue access and setup conditions are workable,
  • ensuring any permissions required for the event are obtained,
  • ensuring the event environment is safe and lawful,
  • making a suitable representative available to receive delivery or service.
12. Event photos and marketing

Unless you tell us otherwise, we may photograph food displays, styling, buffet setups or general event presentation for our marketing and social media, provided doing so is appropriate in the circumstances. If you do not want your event featured, you should tell us at or before booking.

13. Force majeure

We are not liable for failure or delay caused by events outside our reasonable control, including extreme weather, road closure, supplier interruption, power failure, venue issues, industrial action, public emergency, government restrictions or similar events. We will try to act reasonably to minimise disruption.

14. Limitation of liability

To the maximum extent permitted by law, our liability is limited to the amount paid for the relevant service or to re-supplying the relevant service where appropriate. This clause does not apply to the extent a limitation would be unlawful, including where Australian Consumer Law provides otherwise.

15. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantees, rights or remedies you may have under Australian Consumer Law or any other law where those rights cannot lawfully be excluded.

If there is a problem with our goods or services and a remedy is required by law, that remedy will apply despite anything else in these terms.

16. Governing law and changes

These terms are governed by the laws of Victoria, Australia.

We may update these Terms and Conditions from time to time by publishing a revised version on our website. The version in force at the time of your booking or order will generally apply unless we tell you otherwise.

When does a booking become confirmed?

What happens if there is a problem with the service?

If there is a genuine problem with the service, please contact us promptly with the relevant details. We will review the matter in good faith and respond in line with these terms and any rights that apply under law.
